The OneRoom-Hotel.com website is the property of OneRoom Hotel and the website's publication director/editor is Mr Christophe Chancenest.
OVH, a limited liability company with share capital of 7,625 euros, registered in the Roubaix-Tourcoing Trade and Companies Register under number 424 761 419, whose registered office is located at 140 Quai du Sartel, 59100 Roubaix - France, represented by Mr KLABA HENRYK, in his capacity as Managing Director, hosts the OneRoom Hotel website.
The general terms and conditions of sale form an integral part of the rental contract for furnished tourist accommodation. Acceptance of the general terms and conditions of sale is obligatory prior to the conclusion of any rental contract and any additional services. Any reservation request implies acceptance of these general terms and conditions of sale and full and unreserved acceptance of their provisions.
Article 1 - Definitions
In the following, the following terms shall have the following meanings:
"Acknowledgement of receipt": Electronic mail sent by OneRoom Hotel to the Customer, at the final stage of the reservation process, summarizing the reservation validated by the Customer and confirming its receipt by the reservation site www.oneroom-hotel.com. The acknowledgement of receipt does not constitute a booking confirmation.
"Booking Confirmation": A dematerialized document that summarizes the characteristics of the services booked by the Customer, at the end of the booking process and its validation by the Customer, carried out via the Internet on the www.oneroom-hotel.com website, during which the Customer's credit card number is entered as part of an online payment and/or guarantee before proceeding with final validation.
"OneRoom Hotel Contract": Contract for the supply by OneRoom Hotel of all the services defined below and which have been effectively, expressly and in advance ordered by the Customer following validation of his/her online reservation.
"Customer": An individual of legal age who has full legal capacity at the time of signing the Contract and who is present at the time of the stay booked, and who is acting for purposes that do not fall within the scope of his or her commercial, industrial, artisanal or liberal activity.
"Electronic mail": Any message, in the form of text, voice, sound or image, sent via a public communications network, stored on a network server or in the recipient's terminal equipment, until it is retrieved by the recipient.
"Reservation request": Request for reservation of OneRoom Hotel furnished rooms or apartments made by the Customer via mobile internet communication services or the internet.
"Online booking": Booking of furnished rooms or apartments and any additional ancillary services that have been expressly chosen in advance via the online booking form on the OneRoom Hotel website, accessible at www.oneroom-hotel.com, and, more specifically, on the pages opening under the "Your Space" button or tab and then on the "My bookings" menu.
"Complementary services": Services marketed by OneRoom Hotel consisting, within the framework of a OneRoom Hotel contract, of services that are different from and complementary to those consisting of the provision of furnished rooms or apartments, the essential characteristics of which are presented on the www.oneroom-hotel.com website. These services are chosen expressly and in advance by the Customer.
"Website": electronic service operated by OneRoom Hotel on the Internet and mobile Internet network and accessible at the URL address www.oneroom-hotel.com.
Article 2 - Scope of application
These General Terms and Conditions of Sale apply to all use of the Site, in particular to the online marketing of services offered on the OneRoom Hotel Site.
The Site is a platform whose purpose is to offer Customers Properties for rent. ONEROOM HOTEL may be the owner of the Properties or act as an intermediary between the owner of the Property and the Customer, in compliance with the provisions of law no. 70-9 of January 2, 1970, as amended, known as the "Hoguet Law", and decree no. 72-678 of July 20, 1972.
These General Terms and Conditions apply to the rental of furnished tourist accommodation in mainland France and to additional services provided by OneRoom Hotel to customers.
The premises may under no circumstances be used as the Customer's home or principal residence, and the Customer may not engage in any commercial, craft or professional activity there.
It is specified that the furnished rooms and apartments offered for rent on the Site comply with the regulations governing furnished tourist accommodation.
OneRoom Hotel has obtained the necessary authorizations to rent out its accommodation as furnished tourist accommodation and has obtained the necessary declarations and prior authorizations from the landlords. These authorizations are indicated in the furnished holiday rental contracts.
Article 3 - Customer declarations
All customers acknowledge that they have the legal capacity to enter into contracts, i.e. that they have reached the age of majority and are not under guardianship.
The Customer guarantees the truthfulness and accuracy of the information provided.
He also declares that he uses the Website in accordance with these general terms and conditions of sale.
OneRoom Hotel may not enter into a contract with a user who makes fraudulent use of the Site under the terms of Article 313-1 of the French Penal Code or who contravenes these terms and conditions of sale.
The customer undertakes to be present during the booked stay.
Article 4 - Formation of the contract: making a reservation
The customer may make an internet or mobile internet reservation online on the OneRoom Hotel website after validating these general terms and conditions of sale.
The main stages of a reservation are as follows:
- Click on the "Book" icon or go to the page of the OneRoom Hotel accommodation you wish to book;
- Please enter the dates you would like to book your stay;
- Click on the "Book" button;
- The "Reservation" page is displayed, where the customer can check the details of the reservation and correct any errors; the customer must fill in these details;
- Tick the box "I accept the terms and conditions of sale" to signify full acceptance;
- Tick the boxes of the paying options expressly chosen by the Customer, in addition to the price of the main object of the contract, corresponding to the Customer's express consent;
- Click on the "Validate reservation" button; a window indicating "Order with payment obligation" will appear; a new window will appear summarizing the details and total amount of the order; the customer can correct any errors by clicking on the "Modify reservation" button;
- Click on the "Confirm reservation and pay (xx euros)" button;
- A secure "Ogone" payment window will open to allow you to proceed with payment;
- In order to guarantee and pay for a reservation, the customer is asked to provide the name of the credit card holder, the credit card number, the validity date of the credit card and the last three digits on the back of the card (visual cryptogram);
- Transactions are transmitted using SSL (Secure Sockets Layer);
- The amount of the reservation is cashed after confirmation of the reservation by OneRoom Hotel and one month, at the earliest, before moving in;
- The reservation is firm and definitive only after receipt of an acknowledgement of receipt and a confirmation of reservation sent by email to the Customer by the company OneRoom Hotel. The customer is asked to plan to arrive at the OneRoom furnished room or apartment between 3:00 pm and 8:00 pm (give 24:00 notice of arrival time) and to notify OneRoom Hotel in the event of late arrival; please note that OneRoom furnished rooms or apartments equipped with electronic locks are not affected by this condition. Customers may check in as early as 3:00 p.m., with no time limit. Departures must be made before 11:00 a.m. on the day of the end of the stay, failing which an additional day will be charged;
- An electronic invoice will be sent by OneRoom Hotel to the email address provided by the Customer in the "Contact Details" section as soon as payment has been made;
- The customer will also receive the rental contract for the accommodation when the reservation is made. In the event of a dispute, the General Terms and Conditions shall prevail over the rental contract, with the exception of any clauses to the contrary or additional clauses provided for in the said contract;
Please note that different languages are available for the conclusion of the contract, including French and English;
OneRoom Hotel ensures that the Contract is stored on a reliable and durable medium for a period of 10 years. OneRoom Hotel guarantees access to its customers at any time upon request to the following address: contact@oneroom-hotel.com.
Article 5 - Modification of a reservation
Any request to modify a reservation must be made as soon as possible and no later than 15 days before the scheduled arrival date; a customer may modify the date of a reservation only once; the name of the reservation may not be changed.
Reservation changes are binding only after receipt of an amended confirmation email from OneRoom Hotel.
Requests for changes may result in the application of cancellation conditions, particularly if the new reservation request is not available.
The modification may also modify the booking rate according to the new period chosen (normal period or high-demand period). The Customer will be informed of this and may request cancellation of the Contract under the cancellation conditions set out in article 10 of these General Terms and Conditions.
In the event of force majeure or exceptional circumstances, OneRoom Hotel reserves the right to accommodate customers in a nearby furnished tourist accommodation or hotel of equivalent category, without any change in price.
Article 6 - Duration
The duration of the Contract is freely determined by the parties. The expiry date is indicated in the Contract. The rental period may not be extended without the express prior written consent of OneRoom Hotel. Should the Customer wish to extend his/her stay, the same room or apartment will be offered, subject to availability. The Customer shall endeavor to inform OneRoom Hotel as soon as possible. In any event, the duration of the Contract may not exceed 90 consecutive days.
Article 7 - Applicable conditions
7-1 - Inventory
An inventory of fixtures and fittings is attached as Appendix B to the rental contract.
In the absence of a dispute by the Customer within 72 hours of entering the premises, the inventory of fixtures and fittings drawn up by OneRoom Hotel and communicated to the Customer when the reservation is made will be deemed to have been accepted without reservation by the Customer.
At the end of the rental period, if OneRoom Hotel has not received any complaint within 72 hours of the end of the rental period, the premises will be returned in good condition and/or with a full inventory.
In any event, a joint inventory of fixtures may be drawn up if requested by the Customer or OneRoom Hotel upon entry and/or departure.
7-2 - Cleanliness of the furnished room or apartment
The furnished room or apartment must be left clean, and in particular: the kitchen and crockery must be cleaned, the dishwasher must be emptied and the crockery put away, and the garbage cans must be emptied.
Failure to comply with these instructions will result in a 50-euro cleaning charge being deducted from the security deposit.
7-3 - Security deposit
A bank imprint of 500 euros will be made at the time of booking to act as a security deposit if necessary.
This sum will not be debited if the conditions below are met at the end of the stay:
- The furnished room or apartment is returned in the state of cleanliness indicated in the paragraph above;
- The inventory of fixtures on departure corresponds to the inventory of fixtures on arrival, i.e. no equipment has been damaged or is missing;
- Floors, walls and ceilings must be undamaged;
- No additional services to the reservation will have been contracted at the express request of the customer during the stay;
- All linen is returned;
- The customers did not smoke in the furnished accommodation;
- Departure before 11:00 a.m. on the last day of your stay
If this is not the case, a deduction will be made from the sums covering any damage and/or deterioration to the accommodation, furniture, equipment, materials or objects in the accommodation caused by the Customer, as well as any loss of keys or objects or cleaning costs to be retained. The Customer will be notified in advance of any deductions and will be able to obtain, on request, the corresponding receipts, if applicable.
If this amount paid as a guarantee proves to be insufficient, the Customer will pay any additional amount upon presentation of supporting documents by OneRoom Hotel within [...] days.
7-4 - Subletting
The Rental Contract is concluded intuitu personae for the sole benefit of the Customer identified at the head of the Contract.
Any transfer of the Contract, any total or partial subletting, any making available - even free of charge - is strictly forbidden. The Customer may not make the premises available, even free of charge and/or on loan, to a person outside his household.
7-5 - Customer's obligation
The Customer shall make reasonable and peaceful use of the rented furnished room or apartment, furniture and equipment in accordance with the purpose for which they were provided in the Contract. The Customer shall be liable for any damage or loss that occurs during his or her use, unless he or she can prove that he or she is not responsible for such damage or loss.
The Customer acknowledges that this rental is granted only on a temporary basis for a temporary stay, to the exclusion of the exercise of any trade, profession or industry.
The Customer shall maintain the rented furnished room or apartment and return it in a clean and tidy condition. If any of the items listed in the inventory are broken or damaged by the Customer, One Room Hotel may claim their replacement value or deduct them from the security deposit after informing the Customer in advance.
The customer may decide to take out a cleaning package for an additional charge of 50 euros, which will be carried out after departure.
They must avoid any noise that might disturb the peace and quiet of their neighbors, especially noise from radio, television and other equipment.
The furnished apartments and rooms offered on the Site are non-smoking; if a Customer lights a cigarette inside the apartment, a fine of 150 euros will be deducted from the security deposit after having informed the Customer in advance.
It is forbidden for the customer to keep pets.
The customer whose name has been used for the reservation undertakes to be present during the stay.
The Customer shall respect the maximum number of persons who may enter the premises, in accordance with the description of the premises provided. The number of persons may not exceed that stipulated in the description of the premises, except with the prior agreement of OneRoom Hotel. Should this not be the case, OneRoom Hotel shall be entitled to demand additional rent or to require the departure of any excess occupants.
The Customer undertakes to comply with the collective internal regulations when the building is subject to the status of co-ownership, of which he acknowledges having knowledge by ONEROOM HOTEL providing him with a copy of these regulations.
OneRoom Hotel or its agent may enter the premises subject to the Customer's express prior consent.
Article 8 - Financial conditions
8-1 - Prices
Prices are given in Euros. VAT is always included. The prices indicated include only the services strictly mentioned in the reservation (booking fees; internet subscription; TV use; sheets, pillowcases, towels, tea towels; gas/electricity/water consumption; tourist tax, etc.).
A bank imprint of 500 euros will be taken at the time of booking; this will be used as a deposit if necessary.
The bank imprint will be destroyed within a maximum of one month after the Customer's departure, after deduction, where applicable, of sums covering damage and/or deterioration to the furnished room or apartment, and to furniture, equipment, material and objects in the furnished room or apartment caused by the Customer, as well as the loss of keys or objects or any cleaning costs to be retained. The Customer will be notified in advance of any deductions and will be able to obtain, on request, the corresponding receipts where applicable.
The prices mentioned on the website are subject to change, it being specified that the modified prices will only apply to bookings made after the date on which the prices were modified. Only the price indicated at the time of booking is contractual.
8-2 - Terms of payment
Payment is due in Euros.
Payment for the reserved furnished room or apartment and the services mentioned in the reservation and expressly chosen by the Customer will be made, after confirmation of the reservation by OneRoom Hotel and one month, at the earliest, prior to occupancy, by credit card, via the payment module of the OneRoom-hotel.com website.
The Customer warrants that he/she is entitled to use the payment card he/she will use and that the card provides access to sufficient funds to cover the costs of payment.
The commitment to pay given by means of a payment card is irrevocable.
Article 9 - Right of withdrawal
Pursuant to the provisions of Article L 121-21-8 of the French Consumer Code, the services offered on the website by OneRoom Hotel are not subject to the right of withdrawal provided for in Articles L 121-21 et seq. of the French Consumer Code concerning distance selling.
Consequently, the Customer may not invoke the right of withdrawal.
Article 10 - Cancellation conditions
Cancellations made more than 30 days in advance will be 100% refunded.
For cancellations made between 30 days and 7 days before the scheduled arrival date, 30% will be deducted from the price of the reservation.
For cancellations made between 7 days and 3 days before the scheduled arrival date, 50% will be deducted from the price of the reservation.
Reservations cancelled less than 3 days (72 hours) before the scheduled arrival date will not be reimbursed.
To cancel a reservation, customers are invited to visit the OneRoom-Hotel.com website and fill in the form provided for this purpose, which can be accessed as follows: click on "Your Space" in the OneRoom menu bar, then click on "Cancel reservation".
Any reservation cancelled at the request of OneRoom will be the subject of a cancellation email sent to the email address provided by the Customer in the "contact details" form. The amount paid at the time of reservation will be refunded in full to the Customer and may give rise to compensation in the event of prejudice duly demonstrated by the Customer.
Cancellations by fax, telephone or any other means are not accepted.
Cancellation of a reservation requested by email will only be effective after OneRoom Hotel has sent an email to the Customer confirming the cancellation.
The date of receipt of the cancellation form will be taken as the date of cancellation (form available on the www.oneroom-hotel.com website, "Your space" section).
In the event of a no-show and without having informed OneRoom Hotel in advance, the total amount of the stay remains the property of OneRoom Hotel without the Customer being entitled to any reimbursement whatsoever. For stays of 2 nights or more, in the event of a no-show on the first day of the stay, OneRoom Hotel is no longer obliged to keep the room for the remainder of the stay and the payment is retained unless OneRoom Hotel has found another customer in time.
Article 11 - Complaints
Any complaint must be made to the OneRoom Hotel website using the form provided (form available on the www.oneroom-hotel.com website, "Your space" section), within 30 days of the date of stay.
OneRoom Hotel will send the Customer an acknowledgement of receipt by email within 30 days.
Article 12 - Responsibilities
The security of property and persons within OneRoom Hotel furnished rooms and apartments is the responsibility of the Customer, except in cases of fault directly attributable to OneRoom Hotel. Similarly, OneRoom Hotel cannot be held responsible for damage to or theft of vehicles parked outside the rented property.
Finally, OneRoom Hôtel cannot be held liable in the event of non-performance or improper performance of the contract due either to the fault of the Customer or to the insurmountable and unforeseeable fault of a third party to the contract, or to force majeure.
Article 13 - Force majeure
Force majeure is defined as any event external to the parties that is both unforeseeable and irresistible, making performance of the obligation impossible.
This is particularly the case in the event of strike, insurrection, riot, prohibitions decreed by governmental or public authorities...
The party affected by the force majeure must notify the other party as soon as possible.
It is expressly agreed that force majeure suspends the parties' performance of their mutual obligations, and that each party shall bear the costs arising therefrom.
Article 14 - Termination by operation of law
In the event of breach by the Customer or OneRoom Hotel of any of its contractual obligations, the Contract will be terminated automatically. This termination will take effect after a period of 48 hours following notification by registered letter with acknowledgement of receipt or by hand-delivered letter which has remained unsuccessful.
Article 15 - Information technology and civil liberties
OneRoom Hotel is committed to protecting the confidentiality of all of its customers' personal data.
The information requested from the customer at the time of booking is essential for the proper processing of the customer's request and the management of the booking. The only recipient of this information is the OneRoom Hotel company concerned by the reservation request; the information collected on this site may be processed for the purpose of sending newsletters or commercial offers from OneRoom Hotel's partners, subject to the customer's express prior written consent.
It should be noted that any Customer who consents to the communication of individual personal data has an individual right of access, withdrawal and rectification of such data under the conditions laid down by the law of January 6, 1978 relating to data processing, files and freedoms, as amended in 2004. Customers wishing to benefit from this right should send a written request to the following e-mail address: contact@oneroom-hotel.com.
He or she may also, for legitimate reasons, object to the processing of data concerning him or her.
Article 16 - Mediation, applicable law and competent courts
In the event of a dispute concerning the general terms and conditions of sale and/or the Contract, the Customer and OneRoom Hotel will endeavour to find an amicable solution.
Any dispute, claim or litigation relating to the terms and conditions of booking a furnished room or apartment, and more generally to these general terms and conditions of sale and to the Contract entered into with OneRoom Hotel, shall be governed by French law. Any dispute relating to their interpretation and/or performance shall be referred to the French courts.
