PRELIMINARY ARTICLE: DEFINITIONS
"Good ONE ROOM HOTEL : refers to any type of furnished premises intended for habitation and offered for rent by ONE ROOM HOTEL on the Site on a repeated basis for short periods to transient customers who do not elect domicile;
"General Conditions of Use means these general terms and conditions of use of the Site by a User;
"Tenant means the User who rents a Property on the Site;
"Site means the ONE ROOM HOTEL Internet site, accessible from the domain name www.oneroom-hotel.com. The Site includes all IT components (in particular software and IT developments and Web pages, including source and object code programs, domain names, preparatory design work, specifications and preliminary studies, user documentation, database), the graphic charter (including projects, models, prototypes and plans), the content (in particular textual, graphic, sound, photographic and multimedia elements), as well as all related rights;
"User User: refers to the natural or legal person who has registered on the Site;
"ONE ROOM HOTEL ONE ROOM HOTEL : designates the company ONE ROOM HOTEL, a non-professional furnished rental company, whose head office is located at 18 rue de la Promenade, Asnières-sur-Seine (92600), registered in the Nanterre Trade and Companies Register under Siret number 52803243600024. ONE ROOM HOTEL is the holder of a "+++" n°+++ professional card issued by the Préfecture de Police de Paris, enabling it to secure the payment and collection of rents and transactions carried out between Users, in its capacity as agent, in accordance with the provisions of law n°70-9 of January 2, 1970, as amended, known as the "Loi Hoguet", and decree n°72-678 of July 20, 1972.
Article 1 - SCOPE - APPLICABILITY
Access to and use of the Site by the User are subject to the present Terms and Conditions of Use.
IMPORTANT
USE OF THE SITE OR ANY OF ITS FUNCTIONS IMPLIES EXPRESS, PRIOR, FULL AND ENTIRE ACCEPTANCE OF THESE GENERAL CONDITIONS OF USE. ACCESSING AND BROWSING THE SITE CONSTITUTES UNCONDITIONAL ACCEPTANCE OF THE GENERAL TERMS OF USE.
Article 2 - PURPOSE
The purpose of the General Conditions of Use is to define the terms and conditions under which Users access, browse and use the Site.
Article 3 - WEBSITE OPERATION
The Site is a platform whose purpose is to offer Users Property for rent, ONE ROOM HOTEL may be the owner of the Property or act as an intermediary between the owner of the Property and the Renter (see ONE ROOM HOTEL General Terms and Conditions of Sale).
In particular, the Site allows Renters registered in accordance with the terms and conditions set out in article 4 of these Terms and Conditions of Use to :
- Search for properties for rent;
- to conclude the reservation of a Property (rental);
- manage a rental (payment, cancellation...) ;
- post reviews and suggestions for good deals ;
- discover offers from ONE ROOM HOTEL partners.
Article 4 - SITE REGISTRATION
4.1- Registration on the Site as a Renter is free of charge and implies the User's full and unreserved acceptance of these Terms and Conditions of Use.
4.2- To register and benefit from the services offered by ONE ROOM HOTEL via the Site, Users must be at least 18 years of age.
To register, please fill in the form available on the Site's home page (click on the "Your space" button, then click on "Create a new account").
The User then accesses a registration form in which he/she must fill in the required fields.
Mandatory fields are marked with an asterisk (*).
The User guarantees that the data he/she provides via the Site is authentic, accurate, complete and true.
When registering, the User is asked to provide the following information:
- his full name ;
- company name (if applicable);
- a valid email address ;
- a user name ;
- gender;
- country of residence
- date of birth ;
- a password ;
- a cell phone number.
For subsequent connections to the Site, only the email address and password will be required to access the User's account.
4.3- When registering, the User chooses a unique and personal email address and password to access the Site.
The email address and password are personal and confidential. They may only be used by the User. Use of the e-mail address and password is under the User's sole responsibility, and the User undertakes not to transfer or communicate them to any third party.
The password can be changed via the Site by clicking on the "Forgot password" tab and following the steps indicated.
The User then enters a new password, which must be validated.
The User undertakes to use only his active email address and password. Any attempt to access the Site using passwords other than those issued will be considered as an act of computer aggression under the laws in force. Furthermore, ONE ROOM HOTEL reserves the right to terminate access to the Site without the User being entitled to claim any compensation whatsoever.
4.4- Once the registration form has been duly completed, registration is automatically validated and the User receives a welcome e-mail.
Any registration linked to an incomplete form or containing erroneous and/or fanciful information is likely to be refused without compensation or notice by ONE ROOM HOTEL.
The activation of the User's registration by ONE ROOM HOTEL shall under no circumstances be considered as the granting of a guarantee.
4.5- Registration is for an indefinite period. The User retains the right to interrupt registration at any time, without giving any reason.
In addition, ONE ROOM HOTEL reserves the right to terminate and/or suspend the registration of Users, without compensation or notice, and without prejudice to the exercise by ONE ROOM HOTEL of any remedies or recourses it may deem appropriate against Users:
- if required to do so by law or regulation;
- in the event of any doubt as to the good faith of the User, the authenticity of the information provided or, more generally, in the event of non-compliance with any of the terms of these General Terms of Use.
Finally, ONE ROOM HOTEL reserves the right to randomly and periodically verify the accuracy of the information provided by a User.
Article 5 - USE OF THE WEBSITE AND FORMATION OF A CONTRACT
The User accesses the Site via the url www.oneroom-hotel.com.
In order to access the features reserved for Users mentioned in Article 3 of these General Terms and Conditions of Use, the User must register and connect to the Site using his or her e-mail address and password.
5.1. The User may make an internet or mobile internet reservation online on the ONE ROOM HOTEL website after having validated the present terms and conditions of sale.
The main stages of a reservation are as follows:
- Click on the "Book" icon or go to the ONE ROOM HOTEL page you wish to book;
- Please enter the dates you would like to book your stay;
- Click on the "Book" button;
- The "Reservation" page is displayed, where the User can check the details of the reservation and correct any errors;
- Tick the box "I accept the terms and conditions of sale" to signify full acceptance;
- Tick the boxes of the paying options expressly chosen by the User in addition to the price of the main object of the contract corresponding to the User's express consent;
- Click on the "Validate reservation" button; a window indicating "Order with payment obligation" will appear; a new window will appear summarizing the details and total amount of the order; the User can correct any errors by clicking on the "Modify reservation" button;
- Click on the "Confirm reservation and pay (xx euros)" button;
- A secure "Ogone" payment window will open to allow you to proceed with payment;
- To guarantee and pay for a reservation, the User is asked to provide the name of the credit card holder, the credit card number, the validity date and the last three digits on the back of the card (visual cryptogram);
- Transactions are transmitted using SSL (Secure Sockets Layer);
- The amount of the reservation is cashed upon confirmation of the reservation by ONE ROOM HOTEL;
- The reservation is firm and definitive only after receipt of an acknowledgement of receipt and a confirmation of reservation sent by email to the User by ONE ROOM HOTEL. The User is requested to plan an arrival between 3:00 pm and 8:00 pm (to give 24:00 notice of arrival time) and to inform ONE ROOM HOTEL in the event of late arrival; please note that OneRoom furnished rooms or apartments equipped with electronic locks are not affected by this condition. The User may access these rooms from 3:00 pm, with no time limit. Departures must be made before 11:00 am on the day of the end of the stay, otherwise an additional day will be charged;
- An electronic invoice will be sent by ONE ROOM HOTEL to the email address provided by the User in the "Contact Details" section as soon as payment has been made;
- The User will also receive the rental contract for the accommodation at the time of booking. In the event of a dispute, the GCS will take precedence over the rental contract, with the exception of any clauses to the contrary or additional clauses provided for in the said contract.
Please note that different languages are available for the conclusion of the contract, including French and English. In the event of a dispute, the French version shall prevail, the English translation being for information purposes only.
ONE ROOM HOTEL will keep the Contract on a reliable and durable medium for a period of 10 years. OneRoom Hotel guarantees access to its customers at any time upon request to the following address: contact@oneroom-hotel.com.
5.2. Any request to change a reservation must be made as soon as possible and no later than 15 days before the planned date of arrival; the User may only change the date of a reservation once; the name of the reservation may not be changed.
The reservation modification is firm and definitive only after receipt of a modified confirmation email from ONE ROOM HOTEL.
Requests for changes may result in the application of cancellation conditions, particularly if the new reservation request is not available.
The modification may also modify the reservation rate according to the new period chosen (normal period or high-demand period). The User will be informed of this and may request cancellation of the Contract under the cancellation conditions set out in article 10 of the ONE ROOM HOTEL General Terms and Conditions of Sale.
In the event of force majeure or exceptional circumstances, ONE ROOM HOTEL reserves the right to accommodate Customers in a nearby furnished tourist accommodation or hotel of equivalent category, without any change in price.
5.3. ONE ROOM HOTEL makes every effort to ensure the accuracy of all information made available to Users, although it cannot guarantee such accuracy. The User is invited to use such information with discernment and a critical mind. Information reported by Users as containing legal or technical inaccuracies, typographical errors or as being incomplete will be processed without delay by ONE ROOM HOTEL.
In particular, advertisements must not :
- indicate false or misleading information,
- present content of an illicit nature or containing data that constitutes an apology for crimes against humanity, incitement to racial hatred, child pornography, incitement to violence or offenses against human dignity.
5.4. Advertisements are published from the moment they are put online by ONE ROOM HOTEL and may be withdrawn at any time, at ONE ROOM HOTEL's discretion. The fact that an advertisement is present on the site does not guarantee the availability of the Property for rent.
Article 6 - CONNECTING TO THE WEBSITE
6.1- ONE ROOM HOTEL uses its best efforts to ensure the availability of the Site. ONE ROOM HOTEL does not warrant that the Site will operate in any operating environment and will be available for use at all times without interruption or error, or that any errors will be corrected.
6.2- The User is informed that the availability of the Site is subject to a simple obligation of means. ONE ROOM HOTEL shall not be held liable in the event of the Site's unavailability.
6.3- The Site is constantly evolving and is therefore subject to occasional changes and/or temporary or definitive interruptions without prior notice, in particular for maintenance reasons. ONE ROOM HOTEL shall not be held liable in the event of unavailability of the Site due to such changes.
Article 7 - LIABILITY
7.1- ONE ROOM HOTEL may not be held liable for any damage suffered by a User as a result of abnormal use of the services offered on the Site, and in particular in the event of a breach of these Terms and Conditions of Use.
ONE ROOM HOTEL shall not be liable for any direct or indirect damages, losses or expenses resulting from the use of the Site, or from the impossibility of using it, or from a malfunction, an interruption due to maintenance, a technical failure of the server hosting the Site or related to an interruption of Internet access or for any other cause, a virus, or a line or system problem.
When using the Site, the User undertakes in particular to :
- not to modify or alter all or part of the Site;
- not to authorize any third party to use your email address and password;
- not to use the email and password of another User;
- not to disseminate any message(s) or information(s) in any form whatsoever:
o contrary to public order and morality;
o contrary to respect for privacy ;
o abusive, defamatory, racist, xenophobic, revisionist or prejudicial to the honor or reputation of others, inciting discrimination or hatred ;
o threatening a person or a group of persons ;
o of a pornographic or paedophile nature;
o inciting to commit a crime, an offence or an act of terrorism or glorifying war crimes or crimes against humanity;
o inciting to suicide ;
o violating the legislation on the secrecy of correspondence, or, in general, contrary to a regulation in force or a law in force.
7.2 ONE ROOM HOTEL is a third party to the rental contract concluded between the Lessor and the Renter. Consequently, ONE ROOM HOTEL may not be held liable, in particular and without limitation:
- the non-conformity of the Property with the description given in the advertisement posted on the Site;
- the fact that the lessor does not have the necessary rights over the Property to validly enter into a lease contract;
- the absence of any rental conclusions;
- the absence of acceptance by the lessor.
The User guarantees and indemnifies ONE ROOM HOTEL against any damage suffered by ONE ROOM HOTEL and against any liability action brought against ONE ROOM HOTEL on the basis of a breach of these Terms and Conditions of Use.
In the event of serious fraud (falsification, concealment, etc.), the Site authorizes itself to communicate all necessary information to the competent bodies responsible for the repression of said frauds and offences.
Article 8 - INTELLECTUAL PROPERTY
8.1- The Site is protected by intellectual property rights held by ONE ROOM HOTEL. Consequently, they may only be used by the User in accordance with the conditions set out in these General Conditions of Use.
Any other use, in particular constituting counterfeiting, is punishable by law. Any reproduction, even partial, of the contents of the Site is strictly forbidden, except with the prior authorization of ONE ROOM HOTEL.
More generally, any distribution, reproduction, representation or adaptation, in whole or in part, of the Site or any of its elements is prohibited, as is any alteration thereof.
"ONE ROOM HOTEL" is a trademark protected in particular registered with the INPI, on July 4, 2014, under registration number 4102285 (hereinafter referred to as the "Brand"). The domain name oneroom-hotel.com (hereinafter referred to as the "Domain Name") has been reserved by ONE ROOM HOTEL.
Use of the Brand and Domain Name is reserved to ONE ROOM HOTEL. Consequently, the User is not authorized to use, in any manner or form whatsoever, the Trademark and/or Domain Name, except with the prior written consent of ONE ROOM HOTEL. Furthermore, the User undertakes not to register or record all or part of the Brand and/or Domain Name or any similar sign in any way whatsoever with competent bodies.
8.2- The present Terms and Conditions of Use do not imply any transfer of intellectual property rights from ONE ROOM HOTEL to the User.
The User is granted a non-exclusive, revocable and non-transferable license to use the Site for the duration of his registration.
The User undertakes to :
- not to sub-license use of the Site;
- not to assign this license.
Article 9 - PERSONAL DATA
9.1- The Site complies with French standards relating to the protection of privacy and personal data, and in particular with law no. 78-17 of January 6, 1978 relating to information technology, files and civil liberties, amended by law 2004-801 of August 6, 2004.
9.2- When using the Site, the User provides information of a personal nature. The provision of this information is mandatory in order to use the services offered by ONE ROOM HOTEL, particularly in the context of concluding a rental contract. In addition, connection data may be collected by ONE ROOM HOTEL.
The data collected by ONE ROOM HOTEL is confidential and will only be used by its internal services within the framework of the management of the Site for statistical purposes of estimating the frequentation of the Site.
The User may, at any time, object to the use of his or her personal data at no cost, apart from the cost of transmitting the refusal. To do so, simply write to the following e-mail address: contact@oneroom-hotel.com.
9.3-In accordance with the French Data Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, the User has the right to access, modify, rectify or delete any personal data concerning him or her at any time.
To modify personal information, the User may send an e-mail to contact@oneroom-hotel.com.
To cancel an account, the User may send an e-mail to contact@oneroom-hotel.com.
The User may also exercise a right of opposition.
Article 10 - COOKIES
ONE ROOM HOTEL uses temporary internal cookies (non-stored session cookies), intended solely to assist navigation on the Site. The cookies used by ONE ROOM HOTEL are under no circumstances used to collect nominative information about the User.
If the User chooses to reject all cookies (including temporary internal cookies), access to the Site may be restricted.
Article 11 - APPLICABLE LAW - JURISDICTION OF JURISDICTION
The use and operation of the Site are subject to French law. The validity, execution and interpretation of these Terms of Use applicable to the Site are also subject to French law.
IF THE USER IS A PROFESSIONAL MERCHANT, THE EXCLUSIVE JURISDICTION FOR ALL DISPUTES RELATING TO THE INTERPRETATION OR EXECUTION OF THE GENERAL CONDITIONS OF USE IS THE COMMERCIAL COURT OF NANTERRE.
